We stand behind the quality and functionality of GameSmithAI. We offer a 30-day money-back guarantee on all purchases.
If you are not satisfied with GameSmithAI for any reason, please contact us at support@gamesmithai.com within 30 days of your purchase date for a full refund.
Conditions:
- Refunds must be requested within 30 days of the initial purchase date.
- Refund requests must be sent directly to support@gamesmithai.com.
- Access to the software, materials, and associated hosting services will be terminated immediately upon processing the refund.
- Refunds are processed within 3-5 business days to your original payment method.
We reserve the right to deny refunds in cases of abuse, fraud, or evidence of violation of our Terms and Conditions. Initiating a chargeback will result in the immediate and permanent termination of your GameSmithAI account and all hosted content.
Terms and Conditions
1. General License & Access
By purchasing GameSmithAI, you receive a non-exclusive, non-transferable license to use the platform and its features according to your specific subscription tier (Starter, Pro, SaaS, etc.).
1.1 Access Term Definition (Consistent with Sales Pages)
The access granted for a single, one-time payment is for the operational life of the GameSmithAI software product. We commit to maintaining and supporting the service for a minimum period of two (2) years from your purchase date. Access will continue thereafter, provided the GameSmithAI platform remains operational.
1.2 Starter Package Limits
The introductory Starter Package ($27) is subject to the following resource limitations to ensure service stability for all users:
- Maximum of 10 active, hosted games at any given time.
- Maximum of 2 AI chat edits per generated game.
- Unlimited game generation (you can create new games, but only 10 can be actively hosted/edited at once).
2. Permitted Use (You May)
- Create games using our platform by providing text prompts to the integrated AI models.
- Sell, distribute, or monetise the games you create (with paid plans).
- Use the generated games for commercial purposes (with a commercial license).
- Connect your own external API keys (Gemini, OpenRouter) to fuel the AI generation.
3. Prohibited Use (You May NOT)
- Share, sell, or transfer your individual login credentials.
- Resell the GameSmithAI software platform itself (unless you have a separately purchased Agency License or Reseller rights).
- Reverse engineer, decompile, or extract the underlying source code of the GameSmithAI platform.
- Create games containing illegal, harmful, hateful, discriminatory, or highly offensive content.
- Abuse system resources, including excessive API calls, or attempt to bypass the limits set by your purchased tier.
- Violate any third-party intellectual property or copyright rights in the content you input or the games you generate.
4. Service Availability & Support
- Uptime: We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service due to factors beyond our control (AI provider outages, third-party server issues, etc.).
- Maintenance: We reserve the right to perform scheduled and unscheduled maintenance which may cause temporary service interruptions. We will endeavor to provide notice for scheduled maintenance.
- Feature Modification: We reserve the right to modify, update, or discontinue features of the platform at any time, with or without prior notice.
- Support: Technical support is provided via email at support@gamesmithai.com with a target response time of 24-48 business hours.
5. Content & Ownership
- Game Ownership: All games and creative assets generated using the platform are your property (subject to your license level), provided you comply with these Terms and Conditions.
- Third-Party Rights: You are solely responsible for ensuring that the games you create and distribute do not infringe upon any third-party rights.
- AI Content: You acknowledge that AI-generated content may contain similarities to other content generated by the same or different AI models.
- Data Usage: We may use anonymized input prompts and metadata (but not your private game content) to improve our AI models and platform performance.
6. Account Termination
We reserve the right to terminate your account immediately, without refund, if we determine, in our sole discretion, that you have violated these Terms and Conditions, including but not limited to:
- Engaging in fraudulent activity or abuse of the refund policy.
- Sharing or selling login credentials.
- Creating illegal, harmful, or prohibited content.
- Serious and repeated abuse of system resources.
7. Limitation of Liability
GameSmithAI and its services are provided "AS IS" without warranties of any kind, express or implied. Our entire liability to you for any cause whatsoever, and regardless of the form of the action, shall at all times be limited to the amount you paid to us for GameSmithAI.
We are not liable for any indirect, incidental, special, or consequential damages, including, but not limited to, lost profits, lost revenue, lost data, or damages arising from the use or inability to use the platform, or the success/failure of games you create and distribute.
8. Governing Law & Contact
These terms are governed by the laws of England, UK. By using GameSmithAI, you agree to these terms.
